Your Responsibilities under the Health and Safety Executive

At all times a powered gate must respond in a safe way when any person interacts with it. It's design must take into account that foreseeable interactions may go well beyond normal use (eg children playing around or with / on the powered gate), as well as normal wear and tear, and adverse environmental influences, particular wind and rain / snow and other debris that can impair function.

Please note that our assessors are not a health and safety Inspectors. They are competent advisors on HSE regulations and legislation dealing with automated gates and barriers. These advisories are given in their professional and qualified opinion based on their knowledge of current health and safety legislation. It is your responsibility to act upon any advice given by Mere UK assessors and ultimate responsibility lies with you to ensure that you have complied with the appropriate HSE legislation to ensure a safe and compliant environment for all persons.

Our Responsibilities under the Health and Safety Executive

All persons installing a powered gate as part of a work activity must install the product safely to meet their obligations towards other persons under Section 3 of the Health & Safety at Work etc Act 1974 (Section 6(3) of the Act also applies where the powered gate is to be used at work). Manufacturer's instructions for the product and any component parts should be followed, and the gate should always be left in a safe condition.

PLEASE NOTE: Owners and occupiers of commercial premises with powered gates have duties under the Workplace (Health, Safety and Welfare) Regulations 1992. These include basic safety by construction (Regulation 18) and for maintenance (Regulation 5). They may also have duties under Section 3 of the Health and Safety at Work etc Act 1974 for the safety of persons (including the public) they do not employ.

Summary

Even though insurance protects you from health and safety claims, it does not reduce your responsibility to provide a safe work environment and to reduce potential risks. It is a legal responsibility to protect health and safety in the workplace, meaning that criminal charges could be brought in addition to a civil financial case, negligence or a failure to take certain actions may also invalidate your insurance policy.

BS EN 12453:2017

now specifies all safety devices should be inspected at least every 6 months. Maintenance must be documented for the customer to prove that it has been carried out to the required standard.

The Provision and Use of Work Equipment Regulations 1998

Regular maintenance is a legal requirement for commercial and industrial installations under regulation 5 of the Provision and Use of Work Equipment Regulations 1998. The duty is with the employer/owner to ensure that the machinery is maintained. There is an absolute duty to comply with the regulations and it cannot be ignored.

Health and Safety Executive

Under the Management of Health and Safety at Work Regulations 1999, the minimum you must do is:

identify what could cause injury or illness in your business (hazards)
decide how likely it is that someone could be harmed and how seriously (the risk)
take action to eliminate the hazard, or if this isn’t possible, control the risk

Additional Notes from Assessor

As per UK health and safety legislation we would always recommend that a complete service and risk assessment be undertaken every six months on your gate or barrier installation.
